قانون انتقال محکومان به حبس بین ایران و افغانستان ابلاغ شد.

روز سه شنبه، ۵ اردیبهشت/ثور (۲۴ آوریل)، پایگاه اطلاع رسانی دولت ایران گزارش کرد که محمود احمدی نژاد، رئیس جمهوری، قانون "موافقتنامه انتقال محکومان به حبس بین ایران و افغانستان" را امضا و برای اجرا ابلاغ کرده است.

براساس این موافقنامه، در مواردی که شهروند یکی از دو کشور در دادگاه های کشور دیگر محاکمه و به حبس محکوم شده باشد، این امکان وجود دارد که فرد محکوم، این دوره محکومیت را در زندان های کشور خود - که در این قانون کشور اجرا کننده خوانده می شود - سپری کند.

کشوری که محاکمه و صدور حکم در محاکم آن صورت گرفته در این قانون "کشور صادرکننده" خوانده شده است.

روند انتقال محکومان بین دو کشور مستلزم تسلیم درخواست تقاضای انتقال از سوی فرد محکوم، وکیل قانونی و یا خویشاوندان او برای مقامات کشور اجرا کننده است که باید این اسناد را همراه با تقاضای انتقال، به مقامات کشور صادرکننده ارسال کند.

کشور صادر کننده حکم می تواند درخواست انتقال فرد محکوم را بپذیرد و یا رد کند و باید تصمیم خود در این زمینه را ظرف یک ماه از تاریخ وصول اسناد حاوی درخواست انتقال، به اطلاع مقامات کشور اجرا کننده برساند.

به این ترتیب، انتقال محکوم براساس خواست خود او صورت می گیرد و این قانون به دولت های دو کشور اجازه آن را نمی دهد تا بدون رضایت فرد محکوم، خواستار انتقال او شوند.

انتقال فرد محکوم به کشور متبوع او در مواردی امکانپذیر است که حکم مربوطه قطعی و لازم الاجرا بوده، بیش از شش ماه از دوره مجازات این فرد باقی مانده باشد و مقامات مربوطه دو کشور در مورد انتقال فرد محکوم به توافق رسیده باشند.

شرایط انتقال

البته این قانون امکان آن را داده است که در موارد استثنایی، محکومانی که باقیمانده دوره محکومیت آنان کمتر از شش ماه است هم انتقال یابند.

از این پس محکومان افغان محاکم ایران می توانند تقاضا کنند دوره محکومیت خود را در افغانستان بگذرانند

طبق قانون انتقال محکومان بین ایران و افغانستان، پس از انتقال فرد محکوم، هر یک از دو کشور صادر کننده و یا اجرا کننده حکم می تواند طبق قوانین داخلی خود، فرد محکوم را مورد عفو، بخشودگی و تخفیف مجازات قرار دهد اما تجدید نظر در حکم تنها در حوزه اختیارات کشور صادر کننده است.

توافقنامه انتقال محکومین به حبس بین ایران و افغانستان بخشی از برنامه دولت ایران برای انعقاد توافقنامه همکاری حقوقی و قضایی با کشورهای دیگر است.

از جمله، اواخر سال گذشته شمسی، رئیس جمهوری ایران قانون توافقنامه مشابهی بین ایران و عراق را امضا و برای اجرا ابلاغ کرد.

این نخستین بار نیست که مساله نفوذ آب باران به سنگ‌های باستانی محوطه تاریخی ایران مطرح شده است، اما به اعتقاد صاحبنظران به دلیل نبود راه حل مناسب برای نگهداری از این آثار باستانی این بناها در معرض تخریب قرار دارند.

برخی از کارشناسان ساخته شدن سد سیوند در نزدیکی این محوطه را از دلایل افزایش بارش این منطقه عنوان ‌می‌کنند. این در حالی است که گروه دیگری از کارشناسان معتقدند سد سیوند و دریاچه آن باعث افزایش رطوبت منطقه شده و افزایش بارش با احداث این سد ارتباط چندانی ندارد. ساخت سد در مناطق مختلف شرایط و وضعیت آب و هوایی منطقه‌ای که سد در آن ساخته می‌شود را تغییر می‌دهد.

کارشناسان حوزه میراث فرهنگی معتقدند که دریاچه تشکیل شده پشت سد سیوند رطوبت محوطه پاسارگاد را افزایش داده است. براساس آخرین گزارشی که در رسانه‌های ایران منتشر شد، رطوبت محوطه پاسارگاد در اردیبهشت سال ۱۳۸۹به ۳۰ درجه رسید در حالی که نهایت رطوبت پیش از راه اندازی سد سیوند بین ۱۲ تا ۱۵ درجه بوده است.

حال این نگرانی وجود دارد که با توجه به افزایش رطوبت و بارندگی‌های فصلی در این منطقه این آثار تاریخی که به ثبت جهانی نیز رسیده است در معرض تخریب بیشتری قرار بگیرد.

سد سیوند در ۱۰۰ کیلومتری شهر شیراز و در نزدیکی محوطه تاریخی پاسارگاد بر روی تنگه بلاغی ساخته شده است. گفته می‌شود نزدیک به ۱۰۰ محوطه باستانی در این تنگه قرار داشته که با آبگیری این سد در ۳۰ فروردین سال ۱۳۸۶ تمام این آثار به زیر آب رفته است.

اعتراض‌ها به ساخت این سد از پیش از آبگیری این سد آغاز شد و معترضان با برگزاری نشست و ارسال نامه به آیت‌الله علی خامنه‌ای رهبر جمهوری اسلامی ایران و محمود احمدی نژاد رئیس جمهوری و نمایندگان مجلس خواستار توقف در ساخت این سد شدند اما این سد به رغم تمام مخالفت‌ها‌ به دستور آقای احمدی نژاد آبگیری شد.

وسعت دریاچه این سد حدود ۱۵ کیلومتر مربع برآورد شده و ۸۰ میلیارد تومان برای ساخت آن هزینه شده است.

پیشتر این موضوع مطرح شده بود که ساخت سد تنها بر رطوبت این منطقه تاثیر نخواهد گذاشت و موجب تغییر در اکوسیستم منطقه خواهد شد، از جمله این تغییرات افزایش رطوبت، ظهور گیاهان جدید و مهاجرت جانوران به این منطقه خطر تخریب و فرسودگی آثار باستانی را افزایش می‌دهد.

با افزایش رطوبت گل‌سنگ‌ها نیز ظاهر می‌شوند.صاحبنظران بروز این پدیده را معمولی‌ترین وضعیت پیش آمده پس از افزایش رطوبت عنوان می‌کنند. گل سنگ‌ها به راحتی در داخل سنگ نفوذ کرده و سنگ را تخریب می‌کنند.

گل‎‌سنگ‌ها انواع مختلف دارند به همین دلیل برای متوقف کردن رشد هر نوع از آنها نیاز به راهکاری متفاوت است و نکته مهم در خصوص این گیاه آن است که گل‌سنگ از بین نمی‌رود و تنها رشد آن متوقف می‌شود.

در عین حال کارشناسان برای ارائه ادله بیشتر به آثار تاریخی در شمال ایران اشاره می‌کنند. آنان معتقدند که آثار سنگی در شمال ایران به دلیل رطوبت بالا و رشد گل‌سنگ از بین رفته است و تعداد آثار محدود باقی مانده نیز در حال تخریب هستند و دیگر ممکن است نشانی از آنها نباشد.

یکی از راهکارهای ارائه شده برای نجات آثار پاسارگاد، مسقف کردن آن عنوان شده است این در حالی است که گروه دیگری از کارشناسان این راهکار را چندان عملی توصیف نمی‌کنند. آنان معتقدند ممکن است برای بارش نزولات راهی پیدا شود،اما رطوبت محوطه که به داخل سنگ‌ها نفود می‌کند و در اثر سرما یخ زده و سنگ‌ها را شکاف می‌دهد نیاز به کنترل دارد .

به نظر می‌رسد که مسئولان باید هرچه سریع‌تر به دنبال راهی برای نجات این محوطه تاریخی باشند، پیش از آنکه سنگ‌های شکافته جایگزین ستون‌ها برای بیان تاریخ شود.

به گزارش روز سه شنبه ایرنا،در معاملات امروز بازار سرمایه،نمادهای قندی مثل چند روز گذشته همچنان مركز توجه بازار بودند و بیشترین رشد قیمت و صف های خرید متعلق به این گروه ها بود.

همچنین به نظر می رسد بازار با نزدیك شدن به پایان سال جاری در حال بررسی صنایع مختلف برای تعیین صنعت پیشرو سال آینده است و در این میان صنایع كوچك بیشتر از صنایع بزرگ مورد توجه قرار گرفته اند.

پتروشیمی ها نیز پس از روزها رونق مدتی است با بی اقبالی بازار مواجه شده اند و بانكی ها نیز در قعر جدول جای گرفته اند.

در داد و ستدهای روز جاری بورس اوراق بهادار تهران، فعالان این بازار بیش از 119 میلیون سهم و حق تقدم را تغییر مالكیت دادند.

در معاملات امروز 119 میلیون و 663 هزار و 126 برگه سهم و حق تقدم به ارزش 393 میلیارد و 163 میلیون و 99 هزار ریال در 16 هزار و 811 نوبت معاملاتی در بازار داد ستد شد.

در نتیجه این معاملات شاخص كل 143 واحد افت كرد و به رقم 25 هزار و 436 واحد رسید. شاخص صنعت نیز افتی 122 واحدی را تجربه كرد و شاخص 50 شركت فعالتر 5 واحد پایین آمد. همچنین شاخص های بازار اول و دوم به ترتیب 131 و 86 واحد نزول را تجربه كردند.

بیشترین تاثیر منفی در شاخص نیز در نتیجه معاملات نمادهای معدنی و صنعتی چادرملو، معدنی و صنعتی گل گهر، فولاد مباركه اصفهان، سایپا، توسعه معادن و فلزات، صنایع ملی مس ایران، مخابرات ایران، پتروشیمی خارك و بانك ملت بود. در مقابل نماد فولاد خراسان بیشترین تاثیر مثبت را بر شاخص ثبت كرد.

نمادهای پربیننده بازار امروز نیز صدرا، سایپا، قند ثابت خراسان، فولاد مباركه، بانك ملت، صنایع ملی مس، قند شیرین خراسان، گل گهر، سرمایه گذاری غدیر و بانك پاسارگاد بود.

همچنین در پایان ساعت معاملات بیشترین حجم معاملات نیز در نمادهای بانك ملت، سایپا، صدرا، بانك پاسارگاد، چادرملو، سرمایه گذاری بوعلی، توسعه معادن و فلزات، زامیاد و مپنا ثبت شد.

صدرنشینان بازار امروز با بیشترین رشد قیمت نمادهای شهد، قند قزوین، فولاد خراسان، قند اصفهان، قند پیرانشهر، نوسازی و ساختمان تهران، قند ثابت خراسان، قند نیشابور، توریستی و رفاهی آبادگران و صنایع آذرآب بودند.

این در حالی بود كه نمادهای سرمایه گذاری توسعه آذربایجان، حق تقدم كاشی و سرامیك حافظ، حق تقدم جام دارو، بین المللی محصولات پارس، آذریت، چادرملو، لعابیران، حمل و نقل بیم المللی خلیج فارس، زامیاد و توسعه معادن و فلزات با بیشترین كاهش قیمت در انتهای جدول معاملات قرار گرفتند.

سنگین ترین صف های خرید بازار امروز نیز به سهام شركت های قند نیشابور، صنایع آذرآب، قند نقش جهان، قند قزوین، سامان گستر اصفهان، شهد، قند پیرانشهر، قند ثابت خراسان، فولاد آلیاژی و قند هكمتان تعلق گرفت.

این در حالی بود كه صنایع پتروشیمی كرمانشاه، تهران شیمی، گروه صنعتی ملی، بانك اقتصاد نوین، سرمایه گذاری اعتبار ایران، ایران خودرو، لیزینگ صنعت و معدن، حمل و نقل بین المللی خلیج فارس، نورد آلومینیوم و ماشین سازی اراك با طولانی ترین صف های فروش مواجه شدند.
